180 DAYS OF THE APPRAISAL, THE LANDOWNER MAY NOT AGAIN
REQUEST TERMINATION OF THE EASEMENT UNTIL FIVE YEARS
AFTER HIS LAST SUCH REQUEST.
2-515.
(A) THIS SUBTITLE DOES NOT PROHIBIT ANY AGENCY OF
THE STATE OR OF A COUNTY FROM ACQUIRING BY CONDEMNATION
LAND WHICH IS UNDER AN AGRICULTURAL PRESERVATION EASEMENT
HELD BY THE FOUNDATION IF SUCH ACQUISITION IS FOR A
PUBLIC PURPOSE.
(B) IN THE EVENT OF CONDEMNATION OF LAND UNDER AN
AGRICULTURAL PRESERVATION EASEMENT, THE CONDEMNING
AUTHORITY, WHETHER STATE OR COUNTY, SHALL PAY:
(1) TO THE LANDOWNER THE FULL AMOUNT TO
WHICH THE LANDOWNER WOULD BE ENTITLED IF THE LAND WAS NOT
UNDER EASEMENT, LESS ANY AMOUNT PAID TO THE LANDOWNER BY
THE FOUNDATION FOR THE EASEMENT; AND
(2) TO THE MARYLAND AGRICULTURAL LAND
PRESERVATION FUND, AN AMOUNT EQUAL TO ANY AMOUNT PAID BY
THE FOUNDATION FOR THE EASEMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That the
passage of this Act is contingent upon the passage of
either HB/SB ___ (71r1986) or HB/SB ____ (71r1985); and
also upon the passage of either HB/SB ___ (71r1987) or
HB/SB ____ (71r1988) of 1977. Should the appropriate
combination of those measures fail of enactment, the
provisions of this Act are null and void without the need
of further action by the General Assembly.

SECTION 3 2. AND BE IT FURTHER ENACTED, That,
subject to the provisions of Section 2 above, this Act
shall take effect on July 1, 1977.
