LAWS OF MARYLAND
Article 12 7-16. [It shall be unlawful for the] THE County
Commissioners [of Garrett County], or any employee of
[said] THE county, [to] MAY NOT enter into any contract
of sale or purchase to which [said] THE county is a
party, where the amount involved in [said] THE contract
exceeds the sum of [$300.00] $2,500 $1,500 without
advertising for bids in one or more newspapers published
in [said] THE county, the publication of [said] THE
advertisement to appear at least once a week for two
consecutive weeks prior to the date on which bids are to
be filed. Any contract of sale shall be awarded to the
highest responsible bidder and any contract of purchase
shall be awarded to the lowest responsible bidder, but
[said] THE County Commissioners [shall] have the right to
reject any and all bids. Any contract entered into in
violation of the provisions of this section [shall be] IS
null and void[; provided, however, that the] THE
provisions of this section [shall] DO not apply to
necessary repairs made in case of emergency. If any
County Commissioner [shall violate] VIOLATES any
provisions of this section, he [shall be] IS liable to
indictment, and, upon conviction, shall forfeit his
office. This section [shall] MAY not be construed,
however, to apply to the purchase of material, equipment
or other supplies for use in the operation and
maintenance of county roads, as provided by Chapter 888
of the Acts of 1941, and amendments thereto.
SECTION 2. AND BE IT FURTHER ENACTED, That Sections
3(a) and (1) of Article 25 — County Commissioners, of the
Annotated Code of Maryland (1973 Replacement Volume and
1976 Supplement) be and they are hereby repealed and
reenacted, with amendments, to read as follows: Article 25 - County Commissioners 3. (a)        (1) The county commissioners of each county in this State, [except Worcester, (except as provided in
subsections (1), (s) (2), (x) and (x-1) hereof) , Prince
George's, Baltimore, Anne Arundel, Cecil, Howard and
Queen Anne's (except as specifically provided in
subsection (f)) counties,] in addition to, but not in
substitution of, the powers, which have been or may be
granted them, have the following express powers. (2) (I) THE FOLLOWING COUNTIES ARE
EXCEPTED FROM THESE EXPRESS POWERS. (II)  ANNE ARUNDEL COUNTY, (III) BALTIMORE COUNTY,
