ACCORDANCE WITH THIS SUBTITLE WITH THE INDIVIDUAL'S
CONSENT. IF THE INDIVIDUAL IS UNWILLING TO ACCEPT
PROTECTIVE SERVICES VOLUNTARILY, THE DIRECTOR MAY
PETITION THE COURT FOR AN EMERGENCY ORDER FOR PROTECTIVE
SERVICES, AS PROVIDED IN §13-709 OF THE ESTATES AND
TRUSTS ARTICLE, OR FOR APPOINTMENT OF A GUARDIAN OF THE
PERSON, AS PROVIDED IN §13-705 OF THE ESTATES AND TRUSTS
ARTICLE.
(C) THE DIRECTOR SHALL SUBMIT WITH THE PETITION
THE FINDINGS OF THE DEPARTMENTAL INVESTIGATION UNDER
SECTION 93(A) OF THIS SUBTITLE, INCLUDING AN EVALUATION
OF THE MEDICAL, PSYCHIATRIC, AND SOCIAL FACTORS THAT
AFFECT THE INDIVIDUAL'S CONDITION AND A DESCRIPTION OF
RECOMMENDED SERVICES.
(D) THE DIRECTOR SHALL NOTIFY THE STATE DIRECTOR
OF THE OFFICE ON AGING OF EACH GUARDIANSHIP PROCEEDING
THAT IS INSTITUTED BY THE DIRECTOR UNDER THIS SUBTITLE
WHICH INVOLVES A PERSON WHO IS 60 YEARS OLD OR OLDER.
(E) IF THE COURT APPOINTS THE DIRECTOR AS
GUARDIAN, THE GUARDIANSHIP SHALL TRANSFER AUTOMATICALLY
TO EACH INDIVIDUAL WHO BECOMES DIRECTOR UNLESS TERMINATED
BY THE COURT AND MAY NOT BE DELEGATED TO ANY OTHER
PERSON.
105.
(A) A DISABLED PERSONS REVIEW BOARD SHALL BE
CREATED IN EACH COUNTY OF THE STATE AND IN BALTIMORE
CITY.
(B) (1) EACH REVIEW BOARD SHALL CONSIST OF SEVEN
NINE MEMBERS APPOINTED BY THE COUNTY COMMISSIONERS. IN
BALTIMORE CITY AND COUNTIES HAVING A COUNTY EXECUTIVE THE
MEMBERS SHALL BE APPOINTED BY THE MAYOR OR COUNTY
EXECUTIVE, WITH THE ADVICE AND CONSENT OF THE CITY OR
COUNTY COUNCIL AS THE CASE MAY BE.
(2) OF THE SEVEN NINE MEMBERS:
(I) ONE SHALL BE A PROFESSIONAL
REPRESENTATIVE OF THE LOCAL DEPARTMENT OF SOCIAL
SERVICES;
(II) TWO SHALL BE PHYSICIANS, INCLUDING
ONE PSYCHIATRIST FROM THOSE LOCAL DEPARTMENTS OF HEALTH
WHICH EMPLOY PSYCHIATRISTS;
(III) ONE SHALL BE A REPRESENTATIVE OF A
LOCAL COMMISSION ON AGING;
(IV) ONE SHALL BE A PROFESSIONAL
REPRESENTATIVE OF A LOCAL NONPROFIT SOCIAL SERVICE
ORGANIZATION;

(V) ONE SHALL BE AN ATTORNEY; AND
|
|
|
|
|
|
|
|
|
|
|
|
|
