WHEREVER THE SECRETARY IS AUTHORIZED BY LAW TO MAKE
AN APPOINTMENT TO A PARTICULAR POSITION IN THE DEPARTMENT
WITH THE APPROVAL OF THE GOVERNOR, THE SECRETARY MAY NOT
REMOVE THE APPOINTEE WITHOUT FIRST OBTAINING THE
GOVERNOR'S APPROVAL. REVISOR'S NOTE: This section presently appears as
Art. 41, §§ 207(a) through (e) and 208(a) and
(i). The last two sentences of subsection
(d) of this section are new language derived
without substantive change from Art. 41,
§208(e), but modeled after similar language
pertaining to the Secretary of Agriculture. In subsection   (a) of this section, the present reference to appointment of the "first Secretary of Transportation" is deleted as obsolete. In subsection (c) of this section, the present
phrase " {o}n or after April 1, 1971" is
deleted as obsolete. Also, the new phrase
"provided by law" and the new sentence "The
Deputy Secretary serves ... and is entitled to
the salary provided in the State budget" are
added to conform to similar provisions
appearing in NR §1-101(d) and Ag §2-102(c). In subsection (e) of this section, the present
phrase, "and the appointee is to serve at the
pleasure of the Secretary", is deleted to
conform to the similar provisions appearing in
NR §1-101(d) and Ag §2-102(d). New language is added throughout this and
subsequent sections identifying "units" in the
Department in order to refer to the
organizational elements included in the
Department by law under §2-107 of this
subtitle, as well as all other elements in the
Department. The term "unit" is used as the
general nomenclature for the organization and
structure in the Department because it has a
broad and nondescript connotation. The term
"agency" and similar terms are avoided for
they have more of a substantive meaning as to
a type of organization. The only other changes are in style. 2-10 3. GENERAL AUTHORITY AND DUTIES OF SECRETARY. (A) BUDGETS. THE SECRETARY IS RESPONSIBLE FOR THE BUDGET OF HIS
OFFICE AND FOR THE BUDGET OF EACH UNIT IN THE DEPARTMENT.
