provisions of § 5(c) [of this article], the [Department]
ADMINISTRATION by rules and regulations shall establish
standards of care, policies of admission, transfer,
discharge, and after-care supervision. STANDARDS OF CARE
INCLUDE PROVISIONS FOR ADMINISTERING THE SCREENING
PACKAGE APPROVED BY THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE FOR THE EARLY AND PERIODIC SCREENING DIAGNOSIS
AND TREATMENT PROGRAM ESTABLISHED PURSUANT TO TITLE 42, §
1396D(A)(4)(B) OF THE UNITED STATES CODE AND FOR
APPROPRIATE TREATMENT OF CONDITIONS REVEALED BY THE
SCREENING. [and from] FROM time to time [it] THE
ADMINISTRATION shall order [such] changes in the
policies, conduct, or management of the institutions and
agencies [as seems desirable in order] to provide
adequate care for the children, and adequate services to
the courts. The [Department] ADMINISTRATION shall
develop special programs, within each such institution or
agency, [which programs shall be] designed to meet the particular needs of its population. PAYMENT OF ANY COST FOR SCREENING OR TREATMENT SERVICES RENDERED UNDER THIS
SECTION SHALL BE MADE AS FOLLOWS: (1) IF SUCH SERVICES ARE RENDERED BY AN AGENCY OF THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE,
PAYMENT SHALL BE MADE IN ACCORDANCE WITH ARTICLE 43, §601
IN THE SAME MANNER THAT SUCH PAYMENT WOULD BE MADE IF THE PERSON RECEIVING SUCH SERVICE HAS NOT A HARD OF THE STATE; AND (2) IF SUCH SERVICES ARE RENDERED BY AN AGENCY OR PERSON OTHER THAN THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE, THE ADMINISTRATION SHALL PAY THE COST OF THE SERVICES AND SHALL SUBSEQUENTLY ATTEMPT TO RECOVER SUCH COST IN THE SAME MANNER AS IF SUCH SERVICES HAD BEEN RENDERED BY AN AGENCY OF THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE, AND IN ACCORDANCE WITH THE PROVISIONS OF (1) ABOVE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977. Approved May 26, 1977.
