fill the term of office then expiring. In case any commissioner shall be allowed to hold over after the expiration of his term, his successor shall be appointed for the balance of the unexpired term. Vacancies in said Commission shall be filled by the Governor, with the advice and consent of the Senate, for the unexpired term. Each commissioner shall be eligible for reappointment in the discretion of the Governor, with the advice and consent of the Senate. The Governor, with the advice of the Secretary of Licensing and Regulation, may remove any commissioner for inefficiency, neglect of duty, or misconduct in office, giving to him a copy of the charges against him and an opportunity of being publicly heard in person or by
counsel, in his own defense, upon not less than ten days' notice. If such commissioner shall be removed, the Governor shall file in the office of the Secretary of State a complete statement of all charges made against such commissioner, and his findings thereon, together with a complete record of the proceedings. No person shall be eligible for appointment or shall hold the office of commissioner or be appointed by the Commission, or hold any office or position under the Commission, who holds any official relation to any association or corporation engaged in or conducting racing within the State of Maryland, or hold stock or bonds therein, or who
has any pecuniary interest therein.] (A) THE MARYLAND RACING COMMISSION SHALL CONSIST OF TEN MEMBERS, ALL OF WHOM SHALL BE APPOINTED BY THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE. (1)    EACH COMMISSIONER, AT THE TIME OF APPOINTMENT AND QUALIFICATION TO THE COMMISSION, SHALL BE: (I) A RESIDENT OF THE STATE OF MARYLAND WHO SHALL HAVE RESIDED IN THE STATE FOR AT LEAST
FIVE YEARS NEXT PRECEDING APPOINTMENT AND QUALIFICATION;
AND (II) A QUALIFIED VOTER IN THE STATE OF MARYLAND; AND (III) NOT LESS THAN TWENTY-FIVE YEARS OF AGE. (2)     NO PERSON SHALL BE ELIGIBLE FOR APPOINTMENT OR SHALL HOLD THE OFFICE OF COMMISSIONER OR BE APPOINTED BY THE COMMISSION, OR HOLD ANY OFFICE OR POSITION UNDER THE COMMISSION, WHO HOLDS ANY OFFICIAL RELATION TO ANY ASSOCIATION OR CORPORATION ENGAGED IN OR CONDUCTING RACING WITHIN THE STATE OF MARYLAND, OR WHO HOLDS STOCK OR BONDS THEREIN, OR WHO HAS ANY PECUNIARY INTEREST THEREIN.
