AN ACT concerning
Public Service Commission — Organization, Powers
and Duties
FOR the purpose of revising the composition and certain
powers, duties, responsibilities, procedures, and
operations of the Public Service Commission and its
staff; and generally relating to the Public Service
Commission. providing for the quorum requirements
for the Public Service Commission and repealing a
restriction on the function of hearing examiners.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 20 of Article 78 - Public Service
Commission Law, of the Annotated Code of Maryland (1975
Replacement Volume and 1976 Supplement) be and it is
hereby repealed:

[20.
(a) The Commission shall conduct its proceedings
on banc or in panels of not less than three
commissioners. However, the Commission may, at its
discretion, provide that one hearing examiner be included
on a panel, in lieu of a third commissioner, in order to
constitute a panel of three.
(b) The Commission may delegate to a hearing
examiner the authority to conduct any proceeding within
its jurisdiction. In each delegated proceeding, the
