LAWS OF MARYLAND
of Procedure or Rule No. 104 of the Maryland District
Rules, and thereafter, the summons having been returned
non est, the STATE TREASURER, director of finance of
Baltimore City or county treasurer may proceed pursuant
to Rule 105 b, subsection 2 and subsection 3 of the
Maryland Rules of Procedure as amended, or Rule No. 104h
of the Maryland District Rules. SECTION 2. AND BE IT FURTHER ENACTED, That Section
264(e), of Article 27 - Crimes and Punishments, of the
Annotated Code of Maryland (1976 Replacement Volume and
1976 Supplement) be and it is hereby renumbered to be
Section 264(f).
SECTION 3. AND BE IT FURTHER ENACTED, That Section
264(d) of Article 27 - Crimes and Punishments, of the
Annotated Code of Maryland (1976 Replacement Volume and
1976 Supplement) be and it is hereby repealed: Article 27 — Crimes and Punishments 264. [(d) If the trial or other ultimate disposition of
such charge or charges, indictment or indictments,
results in an acquittal or dismissal in favor of the
person or persons so arrested, in connection with which
the money, currency or cash may have been so seized or
captured, the same shall be returned to the person from
whom taken on the expiration of ninety days from such
acquittal or dismissal, unless some other person or
persons claiming to own any or all of the money,
currency, or cash shall have, within ninety days from the
date of the record of the entry of such acquittal or
dismissal applied to the circuit court of the county, for
an order declaring and ordering that such money, currency
or cash in the custody of the director of finance or
county treasurer is the property of the person or persons
so applying and should be returned to him or them
forthwith by the director of finance or treasurer. In
the event some other person or persons so apply, the
court shall hear and determine the issue as in other
cases at law.] SECTION 4. AND BE IT FURTHER ENACTED, That new
Sections 264(d) and (e) be and they are hereby added to
Article 27 - Crimes and Punishments, of the Annotated
Code of Maryland (1976 Replacement Volume and 1976
Supplement) to read as follows: Article 27 — Crimes and Punishments 264. (D) (1) UPON THE ULTIMATE DISPOSITION OF SUCH
CHARGE OR CHARGES, INDICTMENT OR INDICTMENTS, RESULTING
IN ACQUITTAL, DISMISSAL, A STET, OR A NOLLE PROSEQUI, ANY
