SUBPOOL. (E) THE COMMISSIONER SHALL REQUIRE THE JOINT INSURANCE ASSOCIATION, UPON A DETERMINATION OF A LACK OF
AVAILABILITY, TO ACTIVATE ANY OF THE FOLLOWING SUBPOOLS: 1.         LAWYERS' PROFESSIONAL 2.       DENTISTS 3.           ACCOUNTANTS 4.           INSURANCE AGENTS AND BROKERS 5.           DIRECTORS AND OFFICERS LIABILITY, BOARDS OF EDUCATION, UNION OFFICIALS 6.           ENGINEERS 7. NURSING HOMES 8. HOSPITAL PROFESSIONAL LIABILITY 9. ANY OTHER SUBCLASS OF PROFESSIONAL LIABILITY LISTED IN THE CURRENT ISSUE OF THE "AGENTS AND BUYERS GUIDE" MARKETS HANDBOOK COMPILED BY THE EDITORS OF
THE FIRE, CASUALTY AND SURETY BULLETINS. 562. (a) The Commissioner may review the operations of
the association. The Commissioner or any person
designated by him, has the power of visitation of and
examination into the operations and free access to all
the books, records, files, papers and documents that
relate to operations of the association, and may summon,
qualify and examine as witnesses all persons having
knowledge of the operations including officers, agents or
employees. The reports and communications of the
Maryland Professional AND EXECUTIVE Liability Pool and
and the records of the governing committee are not public
documents. (c) In addition to any powers conferred upon him
by this or any other law, the Commissioner may do all
things necessary to enable the State and any insurer
participating in any program approved by the Commissioner
to fully participate in any federal program of
reinsurance which may [not be or hereafter ] NOW EXIST OF
HEREAFTER BE enacted for purposes similar to the purposes
of this subtitle.
SECTION 2. AND BE IT FURTHER ENACTED, That Section
2 of Chapter 546 of the Acts of the General Assembly of
1975 is hereby repealed, it being the intention of the
General Assembly hereby to repeal the automatic
termination date provision of Chapter 546.
