provisions of this subtitle is admissible, and then only
in a prosecution for the crime or crimes specified in the
order of court.] [10-407. (a)        This subtitle does not apply to the Federal
Bureau of Investigation or to any other federal
investigating agency. (b)        An order issued under the provisions of this
subtitle may not direct or compel an employee of a
telephone or telegraph company to an act or furnish
information in violation of federal law.] [10-408. A person who violates the provisions of this
subtitle is guilty of a misdemeanor and upon conviction
subject to a fine of not acre than $1,000 or imprisonment
for not more than 90 days or both. ] SECTION 3. AND BE IT FURTHER ENACTED, That new
Sections 10-401 through 10-412 be and they are hereby
added to Article - Courts and Judicial Proceedings, of
the Annotated Code of Maryland (1974 Volume and 1976
Supplement) to read as follows: Article — Courts and Judicial Proceedings 10-401. AS USED IN THIS SUBTITLE, THE FOLLOWING TERMS HAVE
THE MEANINGS INDICATED: (1)         "WIRE COMMUNICATION" MEANS ANY COMMUNICATION
MADE IN WHOLE OR IN PART THROUGH THE USE OF FACILITIES
FOR THE TRANSMISSION OF COMMUNICATIONS BY THE AID OF
WIRE, CABLE, OR OTHER LIKE CONNECTION BETWEEN THE POINT
OF ORIGIN AND THE POINT OF RECEPTION FURNISHED OR
OPERATED BY ANY PERSON ENGAGED AS A COMMON CARRIER IN
PROVIDING OR OPERATING SUCH FACILITIES FOR THE
TRANSMISSION OF COMMUNICATIONS; (2) "ORAL COMMUNICATION" MEANS ANY ORAL COMMUNICATION UTTERED BY A PERSON EXHIBITING AN EXPECTATION THAT THE COMMUNICATION IS NOT SUBJECT TO INTERCEPTION UNDER CIRCUMSTANCES JUSTIFYING THIS EXPECTATION; (2)            "ORAL COMMUNICATION" MEANS ANY CONVERSATION OR
WORDS SPOKEN TO OR BY ANY PERSON IN PRIVATE CONVERSATION; (3)            "INTERCEPT" MEANS THE AURAL ACQUISITION OF THE
CONTENTS OF ANY WIRE OR ORAL COMMUNICATION THROUGH THE
USE OF ANY ELECTRONIC, MECHANICAL, OR OTHER DEVICE. (4)            "ELECTRONIC, MECHANICAL, OR OTHER DEVICE"
