SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 42 106D(h) of be and it is
hereby added to Article 77 — Public Education, of the
Annotated Code of Maryland (1975 Replacement Volume and 1976 Supplement) be and it is hereby repealed and reenacted, with amendments, to read as follows:
Article 77 - Public Education
42 106D.
(A) The county boards of education may establish
public schools when, in their judgment, it is advisable
to do so, subject to the approval of the State Superintendent and in accordance with the applicable bylaws, rules and regulations of the State Board. Upon approval by the State Superintendent, any elementary or high school, or any school or combination of any grades thereof, so established, shall become a part of the State program of public education. The county board of education, with the advice of the county superintendent
of schools, shall determine the geographical attendance

areas for all such schools established under the provisions of this section.
(B) (H) WITHIN MARYLAND THE DOMICILE OF A PARENT
OR GUARDIAN WHO HAS LEGAL CUSTODY OF A SCHOOL AGE CHILD
IS DEEMED TO BE THE LEGAL RESIDENCE OF THAT CHILD FOR PURPOSES OF (1) ENROLLMENT IN THE PUBLIC SCHOOLS OR (2) IF THE CHILD IS PLACED, PURSUANT TO ANY OTHER PROVISIONS OF THE LAW, INCLUDING A COURT ORDER, IN A SCHOOL OR INSTITUTION OPERATED BY OTHER THAN THE BOARD OF EDUCATION
OF THE COUNTY OF RESIDENCE OR THE SCHOOL COMMISSIONERS OF BALTIMORE CITY, THE CONTRIBUTION BY THE LOCAL BOARD OF EDUCATION OR THE SCHOOL COMMISSIONERS OF THE LOCAL SHARE OF BASIC EXPENSES UNDER SECTION 128A OF THIS ARTICLE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977. Approved May 17, 1977.
