IN THIS ARTICLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
REVISOR'S NOTE: This subsection is new language used
as the standard introductory language to a
definition section.
(B) ANY STATE.
"ANY STATE" MEANS:
(1) ANY STATE, POSSESSION, OR TERRITORY OF
THE UNITED STATES;
(2) THE DISTRICT OF COLUMBIA; AND
(3) THE COMMONWEALTH OF PUERTO RICO.
REVISOR'S NOTE; This subsection is new language
added to avoid repetitive use in this article
of common phrases such as "state, possession,
territory, or the District of Columbia". The
reference to Puerto Rico is added because it
is not a U.S. territory or possession, but is
a commonwealth voluntarily associated with the
United States.
The term "any" is used to distinguish the
defined term from references to "this State"
or "the State", meaning the State of Maryland.
(C) COUNTY.
"COUNTY" MEANS A COUNTY OF THIS STATE AND BALTIMORE
CITY.
REVISOR'S NOTE; This subsection is new language used
to indicate that - unless otherwise defined
(see, e.g., §8-401(b) of this article) — a
reference in this article to "county" includes
Baltimore City. It is added to this article
because Art. 1, §14 provides that "county"
includes Baltimore City "unless such
construction would be unreasonable". The
"unreasonable" language of Art. 1, §14 has
been interpreted various ways and, therefore,
the Commission concluded that an explicit
definition of "county" should be included
here.
(D) DEPARTMENT.
"DEPARTMENT" MEANS THE STATE DEPARTMENT OF
TRANSPORTATION.
