MARVIN MANDEL, Governor
If any person [shall] falsely [make, alter, forge]
MAKES, ALTERS, FORGES or [counterfeit] COUNTERFEITS, or
[cause] CAUSES or [procure] PROCURES to be falsely made,
altered, forged or counterfeited, or [shall] willingly
[aid] AIDS or [assist] ASSISTS in falsely making,
altering, forging or counterfeiting, or [shall utter]
UTTERS, [or pass] PASSES OR POSSESSES, knowing it to be
falsely made, altered, forged or counterfeited, any
order, paper, letter writing, prescription, recipe or
other device purporting to have been made by a regular
practicing physician
DULY LICENSED PRACTITIONER, for any
drugs, medicines, spirituous or fermented liquors OR
OBTAINS OR ATTEMPTS TO OBTAIN ANY PRESCRIPTION DRUG BY
FRAUD, DECEIT, OR MISREPRESENTATION, OR SUBTERFUGE, [he]
THAT PERSON shall be deemed guilty of a misdemeanor, and
on conviction in any court in this State shall be
[sentenced to the jail, the house of correction or
penitentiary,] IMPRISONED for not less than six months
nor
more than two years, in the discretion of the court.
If upon trial of any person charged with, or indicted for
[such] THAT misdemeanor, it [shall appear] APPEARS that
he paid for, or offered or promised to pay for, the
drugs, medicine, spirituous liquor or fermented liquor
obtained by means of [such] THE falsely made, altered,
forged or counterfeited order, paper, letter writing,
prescription, recipe or other device purporting to have
been made by a regular practicing physician DULY LICENSED
PRACTITIONER, he [shall] MAY not by reason thereof be
acquitted or [such] THE misdemeanor.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977. Approved May 17, 1977.
