2496 LAWS OF MARYLAND                           Ch. 579
Article 43 — Health Section 130(h)(4) and (m-1) Annotated Coda of Maryland (1971 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 130(h) (4) of Article 43 - Health,
of the Annotated Code of Maryland (1971 Replacement
Volume and 1976 Supplement) be and it is hereby repealed: Article 43 - Health 130. (h) When the Commission has completed its
investigation according to the process outlined herein,
it may reprimand a physician or place him on probation,
revoke or suspend his license, or dismiss the charges
against the physician for any of the causes listed below
as unprofessional conduct: [(4) Conviction of a crime involving moral
turpitude.] SECTION 2. AND BE IT FURTHER ENACTED, That new
Sections 130(h) (4) and (m-1) be and they are hereby added
to Article 43 — Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement) to read as
follows: Article 43 - Health 130. (h) When the Commission has completed its
investigation according to the process outlined herein,
it may reprimand a physician or place him on probation,
revoke or suspend his license, or dismiss the charges
against the physician for any of the causes listed below
as unprofessional conduct: (4) THE PHYSICIAN HAS BEEN CHARGED WITH A
CRIME INVOLVING MORAL TURPITUDE, AND HAS ENTERED A NOLO
CONTENDRE OR GUILTY PLEA OR HAS BEEN CONVICTED OF THE CRIME. (M-1) (1) WHERE THE COMMISSION HAS ORDERED
SUSPENSION OR REVOCATION OF A LICENSE BASED UPON THE
PHYSICIAN'S ENTRANCE OF A PLEA OR CONVICTION OF A CRIME
UNDER SUBSECTION (H)(4), THE SUSPENSION OR REVOCATION MAY
BE ORDERED TO TAKE EFFECT IMMEDIATELY, NOTWITHSTANDING
ANY APPEAL OR OTHER POSTCONVICTION PROCEEDING IN THE
CRIMINAL CASE. HOWEVER, IF THE PLEA OR CONVICTION IS
OVERTURNED AT ANY STAGE IN THE CRIMINAL APPELLATE OR
POSTCONVICTION PROCESS, THE SUSPENSION OR REVOCATION
SHALL TERMINATE IMMEDIATELY.
