CHAPTER 472 (House Bill 717) AN ACT concerning Kent County — Alcoholic Beverages FOR the purpose of altering the hours on Sunday for the
consumption of alcoholic beverages as to Class C
licensees in Kent County; and clarifying language. BY repealing and reenacting, with amendments, Article 23 — Alcoholic Beverages Section 101 Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 101 of Article 2B - Alcoholic
Beverages, of the Annotated Code of Maryland (1976
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows: Article 2B - Alcoholic Beverages 101. In Kent County, notwithstanding any other provision
of this subtitle, it shall be unlawful for any person to
sell or for any retail dealer to give alcoholic beverages
between the hours of midnight on Saturday and 6:00 a.m.
on Monday, except as to Class C, beer, wine and liquor
license (on-sale) club under which it shall be lawful to
keep for sale and sell in Kent County, for consumption on
the licensed premises alcoholic beverages on Sunday
between the hours of [2:00 o'clock p.m.] 12:00 1:00 P.M.
and midnight. Also on Sunday between the hours of 2:00
1:00 o'clock p.m. and midnight, bona fide restaurants
holding a Class B beer, wine and liquor license shall be
permitted to serve alcoholic beverages for consumption on
the premises only as a supplement to meals (which
requires that the total alcoholic beverage bill cannot
exceed the total price of the meal) and only when seated
at a table (and not from a bar or bar stools). The word
"restaurant" when applied to Kent County, shall mean a
business establishment for the accommodation of the
public, fully equipped with a proper and adequate dining
room and with sufficient facilities for preparing and
serving meals, which has been approved by the board of
license commissioners of Kent County, wherein the average
daily receipts from the sale of food comprise at least
[sixty per centum] 60 PERCENT of the average daily
receipts of the [said] business. Any person selling or
any retail dealer giving alcoholic beverages in Kent
