deceit, and financial hardship; to encourage
competition, fair dealing, and prosperity in the
field of invention development services by requiring
adequate disclosure and financial security;
permitting certain remedies, and investigative
powers by the Attorney General providing that
certain actions concerning invention services are
unfair or deceptive trade practices under the
Consumer Protection Act.
BY adding to repealing and reenacting, with amendments,
Article - Commercial Law
Section 14-1301 through 14-1311, inclusive, to be
under the new subtitle "Subtitle 13.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 14-1301 through 14-1311,
inclusive, to be under the new subtitle "Subtitle 13.
Regulation of Invention Development Services" be and they
are hereby added to Section 13-301(9) of Article -
Commercial Law, of the Annotated Code of Maryland (1975
Volume and 1976 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:

SUBTITLE 13. REGULATION OF INVENTION DEVELOPMENT
SERVICES
14-1301. DEFINITIONS.
(A) IN THIS SUBTITLE, THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED, UNLESS A DIFFERENT MEANING CLEARLY
APPEARS FROM THE CONTEXT.
(B) "CONTRACT FOR INVENTION DEVELOPMENT SERVICES"
MEANS A CONTRACT BY WHICH AN INVENTION DEVELOPER
UNDERTAKES INVENTION DEVELOPMENT SERVICES FOR A CUSTOMER.
(C) "CUSTOMER" MEANS ANY PERSON, FIRM,
PARTNERSHIP, CORPORATION, OR OTHER ENTITY THAT IS
SOLICITED BY, OR ENTERS INTO A CONTRACT FOR INVENTION
DEVELOPMENT SERVICES WITH, AN INVENTION DEVELOPER.
(D) "INVENTION DEVELOPMENT" MEANS THE EVALUATION,
PERFECTION, MARKETING, BROKERING, OR PROMOTING OF AN
INVENTION BY AN INVENTION DEVELOPER, INCLUDING A PATENT
SEARCH, PREPARATION OR PROSECUTION OF A PATENT
APPLICATION, AND ANY OTHER ACT BY AN INVENTION DEVELOPER
DONE FOR CONSIDERATION FOR THE PURPOSE OF PROCURING OR
ATTEMPTING TO PROCURE A LICENSEE, BUYER OR PATENT FOR AN
INVENTION. INVENTION DEVELOPMENT DOES NOT INCLUDE THOSE
