MARVIN MANDEL, Governor                              2101 the Annotated Code of Maryland (1969 Replacement Volume
and 1976 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows: Article 87 - Sheriffs 53. (b) (1) The provisions of this subtitle are
applicable in Carroll County, CECIL COUNTY, and Frederick
County respectively, except as modified herein. The
sheriff of the county shall appoint not more than six
members of any fire company as deputies to function as
fire police. The powers of such deputies are limited to
those necessary to perform their duties when functioning
as fire police at parades, accidents, floods or other
emergencies, or at any public function conducted by, or
under the auspices of, any volunteer fire company. Such
powers may be exercised in incorporated cities, or towns,
but only under the discretion and control of the chief of
the police force of the city or town. All fire police,
when on such duty, and when wearing a badge of authority,
shall be deemed to be performing the duties of their
office. (2)   At no time shall any fire police use any
weapon in the performance of his duties as described in
this section. (3)  Any duly authorized fire police performing
his duties in an emergency situation to which a fire
company or ambulance company has been dispatched by the
Frederick County central alarm board in Frederick County
or the Carroll County communications control center in
Carroll County, shall be subject to the authority of the
officer in charge of such fire company or ambulance
company, and if the fire police is not a member in good
standing of such fire company or ambulance company, then
he may not perform his duties as described in this
section. Any duly authorized fire police performing his
duties at any public function conducted by, or under the
auspices of, a fire company or ambulance company, shall
be subject to the authority of the officer in charge of
such company. (4) The sheriff of the county may require any
fire police to demonstrate a satisfactory level of
training in those areas of law enforcement commensurate
with the duties of the fire police as described in this
section. If the sheriff of the county shall require a
demonstration of a satisfactory level of training, then
the training shall be provided by the sheriff of the
county, at a time and place as he shall deem suitable.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
