2028                                            LAWS OF MARYLAND                                  Ch. 316
(I) THE HEARING BOARD MAY REQUIRE A COMPLETE AND INDEPENDENT DIAGNOSIS, EVALUATION, AND PRESCRIPTION OF EDUCATIONAL PROGRAMS FOR THE CHILD,
CONDUCTED BY QUALIFIED PERSONS, THE COST OF WHICH SHALL
BE PAID BY THE STATE BOARD OF EDUCATION. (II) THE MARYLAND SCHOOL FOR THE BLIND SHALL PROVIDE ANY EDUCATIONAL RECORDS OF THE CHILD AS REQUIRED BY THE HEARING BOARD. (4) THE REVIEW CONDUCTED BY THE HEARING BOARD SHALL BE CONDUCTED IN ACCORDANCE WITH BYLAWS DEVELOPED BY THE STATE BOARD OF EDUCATION CONSISTENT WITH
PROVISIONS OF THIS SECTION AND APPLICABLE FEDERAL LAW. (5) THE HEARING BOARD SHALL RENDER ITS
DECISION WITHIN 60 DAYS FROM RECEIPT OF THE REQUEST FOR
REVIEW. (6) IN THE EVENT THAT THE STATE BOARD OF EDUCATION DOES NOT COMPLY WITH PARAGRAPH (5), THE CIRCUIT
COURT FOR THE COUNTY IN WHICH THE CHILD RESIDES AND, IF
THE CHILD RESIDES IN BALTIMORE CITY, ANY ONE OF THE THREE
COMMON-LAW COURTS OF THE SUPREME BENCH,, UPON PETITION,
SHALL REVIEW THE DECISION OF THE MARYLAND SCHOOL FOR THE
BLIND.
(7) SUBJECT TO THE STANDARDS ADOPTED AND
APPROVED UNDER (D) ABOVE, THE HEARING BOARD SHALL EITHER
AFFIRM, MODIFY OR REJECT THE DECISION UNDER REVIEW. (I) THE STATE BOARD OF EDUCATION SHALL REQUIRE THE MARYLAND SCHOOL FOR THE BLIND TO IMPLEMENT THE DECISION OF THE HEARING BOARD, PROVIDED THAT THE PARENT OR GUARDIAN OR THE MARYLAND SCHOOL FOR THE BLIND
MAY APPEAL FROM THE DECISION OF THE HEARING BOARD. (8) APPEAL FROM THE DECISION OF THE HEARING BOARD SHALL BE TO THE CIRCUIT COURT FOR THE COUNTY IN WHICH THE CHILD RESIDES; AND, IF THE CHILD RESIDES IN BALTIMORE CITY, TO ANY ONE OF THE THREE COMMON-LAW COURTS
OF THE SUPREME BENCH. (9) ANY APPEAL OR REVIEW BROUGHT BEFORE THE
SUPREME BENCH OF BALTIMORE CITY AND THE CIRCUIT COURT OF
THE COUNTY UNDER PARAGRAPHS (6) OR (8) SHALL BE HEARD AND
A DECISION RENDERED BY THE COURT AS SOON AS PRACTICABLE.
THE RULING OF THE COURT SHALL BE ENFORCEABLE BY THE COURT
WHICH RULING SHALL BE SUBJECT ONLY TO THE MARYLAND RULES
OF PROCEDURE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977. Approved May 17, 1977.
