AN ACT concerning
Elections - Polling Places
FOR the purpose of requiring a polling place to be
structurally barrier free, if such a place is
Available to the extent feasible, in order to permit
access, for the purpose of voting, to physically
handicapped voters; and providing a procedure for
the assignment of a qualified physically handicapped
voter to an alternate polling place, subject to
certain conditions and limitations; and providing
that this Act is contingent upon a certain
Constitutional Amendment.
BY repealing and reenacting, with amendments,
Article 33 — Election Code
Section 2-11 (a)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 2-11(a) of Article 33 - Election
Code, of the Annotated Code of Maryland (1976 Replacement
Volume and 1976 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:
Article 33 - Election Code
2-11.
(a) (1) It is the duty of the respective boards
to appoint and to provide for furnishing, heating,
lighting and cleaning, a suitable polling place in each
precinct, which shall be as near the center of the voting
population of the precinct as practicable. Whenever all
three members of any board shall file in their office a
statement in writing that a suitable place cannot in
their judgment be secured in any precinct, a suitable
place in an adjoining precinct may be provided. In no
case shall an election be held in any building or part of
any building used or occupied as a saloon, billiard hall
or bowling alley or communicating therewith by doors or
