certain age under certain circumstances; providing
for a penalty upon conviction; giving this act a
prospective effect; providing for the prosecution of
persons committing certain crises repealed or
redefined by this act when those crimes are
committed prior to this repeal or redefinition; and generally relating to the crime of rape; and altering the structure of the codification of Section 462 of Article 27. BY repealing and reenacting, with amendments, Article 27 - Crimes and Punishments Section 462 and 463 Annotated Code of Maryland (1976 Replacement Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 462 and 463 of Article 27 -
Crimes and Punishments, of the Annotated Code of Maryland
(1976 Replacement Volume and 1976 Supplement) be and they
are hereby repealed and reenacted, with amendments, to
read as follows: Article 27 — Crimes and Punishments 462. [(a) A person is guilty of rape in the first degree
if the person engages in vaginal intercourse: (1) With another person by force or threat
of force against the will and without the consent of the
other person and: (i) Employs or displays a dangerous or
deadly weapon or an article which the other person
reasonably concludes is a dangerous or deadly weapon; or (ii) Inflicts                              suffocation, strangulation, disfigurement, or serious physical injury
upon the other person or upon anyone else in the course
of committing the offense; or (iii) Threatens or places the victim in
fear that the victim or any person known to the victim
will be imminently subjected to death, suffocation,
strangulation, disfigurement, serious physical injury, or
kidnapping; or (iv) The person commits the offense
aided and abetted by one or more other persons; or.] (a) A person is guilty of rape in the first degree if the person engages in vaginal intercourse with another person by force against the will and without the consent
of the other person and:
