(B) A PERSON LAWFULLY ADMINISTERING A DRUG OR
VACCINE IS NOT LIABLE FOR ANY ADVERSE EFFECT ARISING FROM
ITS USE IF:
(1) IT WAS ADMINISTERED FOR THE PURPOSE OF
IMMUNIZING AN INDIVIDUAL AGAINST A DISEASE; OR
(2) THE INDIVIDUAL TO WHOM IT IS
ADMINISTERED IS REQUIRED BY LAW OR REGULATION TO BE
IMMUNIZED AGAINST THAT DISEASE; OR
(3) THE DRUG OR VACCINE IS APPROVED BY THE
UNITED STATES FOOD AND DRUG ADMINISTRATION FOR THE
PURPOSE FOR WHICH IT IS ADMINISTERED.
(C) THIS SECTION DOES NOT EXEMPT:
(1) ANY PERSON FROM LIABILITY FOR GROSS
NEGLECT; OR
(2) DRUG MANUFACTURERS FROM THE DUTY TO USE
ORDINARY CARE IN THE PREPARATION OR HANDLING OF A DRUG OR
VACCINE; OR
(3) ANY PERSON FROM LIABILITY ARISING OUT OF
THE IMPROPER OR ILLEGAL ADMINISTRATION OF A DRUG OR
VACCINE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
