BY repealing and reenacting, with amendments,
Article 59A - Mental Retardation
Section 25 (c) and (d)
Annotated Code of Maryland
(1972 Replacement Volume and 1976 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 25(c) and (d) of Article 59A -
Mental Retardation, of the Annotated Code of Maryland
(1972 Replacement Volume and 1976 Supplement) be and they
are hereby repealed and reenacted, with amendments, to
read as follows:
Article 59A — Mental Retardation
25.
(c) Any modification of liability for charges
based on the federal income tax return shall become
effective as of the first day of [May] JULY in each
calandar year.
(d) Each legally liable person shall elect which
schedule he is to be billed under on forms to be
furnished by the Secretary of Health and Mental Hygiene,
the election to become effective as of the [beginning of
the next succeeding calendar year] FIRST DAY OF ADMISSION
OF THE MENTALLY RETARDED PERSON FOR SERVICE. Any election
shall remain in force until modified by the legally
liable person and any modification shall become effective
[at the beginning of the calendar year next succeeding
the year during which it is made] THE FIRST DAY OF JULY
FOLLOWING THE DATE OF MODIFICATION. If a legally liable
person fails to elect within the time limited, the
Secretary shall determine which schedule is to apply.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
