Art. 1A, §6-802(b)(1), the second clause of
(b)(2), and (c).
Throughout this section and elsewhere in this
subtitle, the phrase "or other vegetation" is
added as a more correct, specific substitution
for the phrase, presently appearing in the
definition of "tree" in Art. 1A, §1-123: "any
object of natural growth".
In subsection (a) of this section, the present
references to "modifying", "supplementing", or
"changing" a regulation are deleted as
redundant.
In subsection (b) of this section, the present
references to a "tree" are deleted to conform
to the modification made in §5—504 of this
subtitle; see revisor's note to that section.
In subsection (b)(1) of this section, the
present reference to "lowering or other
change" is deleted as redundant.
In subsection (c) of this section, the
introductory phrase, " {e}xcept as otherwise
provided...", is new language added since
§5—509 (g) of this subtitle does permit a
turning zone district at BWI of 4 miles from
the center, which in some instances may exceed
3 miles from the outer perimeter.
The first clause of present subsection (b)(2),
which states that all regulations "shall have
full force of law", is deleted as an
unnecessary statement of the obvious; cf.
§5-511 of this subtitle, which establishes
criminal penalties for violation of any of
these regulations.
The only other changes are in style.
5-504. VIOLATION OF REGULATIONS.
(A) PROHIBITED ACTIVITIES.
A PERSON MAY NOT, IN VIOLATION OF THIS SUBTITLE OR
ANY REGULATION ADOPTED UNDER IT:
(1) ESTABLISH OR CONSTRUCT ANY NEW STRUCTURE;
(2) MAKE AMY NEW USE OF ANY EXISTING
STRUCTURE OR LAND;
(3) SUBSTANTIALLY ALTER ANY EXISTING
STRUCTURE OR USE OF LAND; OR
(4) AS TO ANY TREE OR OTHER VEGETATION:
