(2) The Administration shall set the hearing
for a date within 30 days of the driver's detention.
However, the hearing may be held at any other time
within the 30-day period on agreement of the driver and
the Administration, and may not be held after the 30 day
period except on good cause shown to the satisfaction of
the Administration.
(3) At the hearing, the driver may present
evidence about his refusal to take the test and may be
represented by an attorney.
(4) After the hearing, the Administration
may suspend the driver's license or privilege to drive
for not more than 60 days. Failure of the driver to
attend the hearing is prima facie evidence of his
inability to answer the sworn statement of the police
officer, and the Administration summarily may suspend
his license or privilege to drive for not more than 60
days.
(f) Court review of suspension of license or
privilege to drive.
If the Administration imposes a suspension after a
hearing, the individual whose license or privilege to
drive has been suspended may appeal the final order of
suspension as provided in Title 12, Subtitle 2 of this
article.
SECTION 2. AND BE IT FURTHER ENACTED, That Section
10—303 of Article — Courts and Judicial Proceedings, of
the Annotated Code of Maryland (1974 Volume and 1976
Supplement) be and it is hereby repealed and reenacted,
with amendments, to read as follows:
Article - Courts and Judicial Proceedings
10-303.
The specimen of breath[,} OR blood[, or urine] shall
be taken within two hours after the person accused is
apprehended.
SECTION 3. AND BE IT FURTHER ENACTED, That Sections
10-302 and 10-304(b) of Article - Courts and Judicial
Proceedings, of the Annotated Code of Maryland (As
onacted amended by Chapter ____ (Senate Bill 40) of the
Acts of the General Assembly of 1977) be and they are
hereby repealed and reenacted, with amendments, to read
as follows:
