In subsection (a) of this section, the present
reference to "real or personal" property and
to "any interest" in the property is deleted
as unnecessary in light of the definition of
"property" in § 1-101 of this article. Also,
the present reference to a "devise" is deleted
as unnecessary in light of the definition of
"gift" in Art. 1, §22 of the Code.
Also in subsection (a) and throughout this
subtitle, the term "airport facility" is added
to reflect the division of the present,
synonymously defined terms "airport" and
"airport facility"; in this regard, see
revisor's notes to the new definitions of
these terms in §5-101 of this title.
The only other changes are in style.
As to gifts, see, also, Art. 15A, §§5 and 6 of
the Code governing gifts and legacies received
by a State agency.
5-406. DISPOSITION OF PROPERTY BY ADMINISTRATION.
(A) DISPOSITION OF PROPERTY AUTHORIZED.
WITH THE APPROVAL OF THE SECRETARY, THE
ADMINISTRATION MAY SELL, LEASE, OR OTHERWISE DISPOSE OF
AMY PROPERTY THAT IT ACQUIRES UNDER THIS SUBTITLE.
(B) MANNER OF DISPOSITION.

(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF

|
|
|
|

|
|
THIS SUBSECTION, THE ADMINISTRATION SHALL DISPOSE OF ITS
PROPERTY IN ACCORDANCE WITH THE LAWS OF THIS STATE
GOVERNING THE DISPOSITION OF STATE PROPERTY GENERALLY.

|
|
|
|
|
|
|
(2) THE ADMINISTRATION MAY TRANSFER ANY OF
ITS PROPERTY FOR ANY AERONAUTICS PURPOSE TO ANY POLITICAL
SUBDIVISION, ANY STATE GOVERNMENT, OR THE FEDERAL

|
|
|
|
|
|
|
GOVERNMENT IN THE MANNER AND ON THE TERMS THAT THE
SECRETARY CONSIDERS TO BE IN THE BEST INTEREST OF THIS
STATE.
