nor may these funds be trans-
ferred by budget amendment.
Funds herein appropriated in
the amount of $130.000, for
a consultant study for the
North Central Rail Project
shall not be expended unless
the City of Baltimore transfers,
or takes action to transfer,
a portion of its interstate
funds in support of the con-
struction of this project;
provided, however, that nothing
herein shall prevent the ex-
penditure of all or any portion
of said $130.000, as may be
necessary to enable the De-
partment of Transportation to
apply for Federal Funding of
said Northern Central Rail
Project, regardless of the source
of said Federal Funds. provided,
further, that if If
these funds are not ex-
pended for this study.
the funds shall revert to
the Transportation Trust
Fund.
The Department of Trans-
portation shall not expend funds
of any job or position of em-
ployment approved by this budget
in excess of 9,000 positions of
the total authorized amount
established in the budget for
the Department of Transportation
at any one time during fiscal
year 1978. and that the Sec-
retary of Transportation util-
ize his prerogatives under
Article 41, Section 208 to im-
plement this provision, pro-
vided however, that any au—
thorized job or position to be
filled above the ceiling of
9.000 is approved by the Board
of Public Works and shall not
count against the Rule of 500
imposed by the General Assembly.
The establishment of new jobs or
positions of employment not au-
thorized in the fiscal year 1978
budget shall be subject to Ar-
ticle 78A, Section 16B(a) and
the Rule of 500. Excess funds
generated as a result of this
ceiling shall be used to off-
set the need for the issuance
