24-203. AUTHORITY OF STATE HIGHWAY ADMINISTRATION TO
PRESERVE STATE HIGHWAYS.
(A) IN GENERAL.
(1) THE STATE HIGHWAY ADMINISTRATION MAY
ADOPT RULES, REGULATIONS, AND ORDERS NECESSARY FOR THE
PRESERVATION OF STATE HIGHWAYS.
(2) THESE RULES, REGULATIONS, AND ORDERS MAY
INCLUDE PROVISIONS TO REGULATE:
(I) THE USE OF STATE HIGHWAYS BY VEHICLES OR
OTHER OBJECTS THAT CAUSE MORE THAN ORDINARY WEAR AND TEAR
OF THE HIGHWAYS; OR
(II) THE USE OF ANY STATE HIGHWAY THAT IS IN
DANGER.
(B) NOTICE.
BEFORE ANY RULE, REGULATION, OR ORDER MAY BE ADOPTED
UNDER THIS SECTION, IT SHALL BE PUBLISHED ONCE A WEEK FOR
3 SUCCESSIVE WEEKS IN A NEWSPAPER OF GENERAL CIRCULATION
IN THE COUNTY IN WHICH THE AFFECTED HIGHWAY LIES.
(C) VIOLATION PROHIBITED.
A PERSON MAY NOT KNOWINGLY VIOLATE ANY RULE,
REGULATION, OR ORDER ADOPTED UNDER THIS SECTION.
REVISOR'S NOTE: This section is new language derived
from Art. 89B, §66.
In this section and throughout this subtitle,
"State Highway Administration" is substituted
for obsolete references to the "State Roads
Commission"; in this regard, see revisor's
note to §8—207 of this article.
In subsection (a) (2) of this section, the
present specific reference to "traction
engines, wagons, {and} sleds" is deleted as
obsolete and, in any event, superfluous in
light of the general reference to "vehicles or
other objects".
Subsection (a)(2) (ii) is new language added
for clarity; it is derived from the implied
authority of subsection (a) (2) (i) as well as
the provisions of present Art. 66 1/2,
§14-113 — now §24-204 of this subtitle.
