are revised to refer expressly to those repair
order certifications.
Throughout this section, present express
references to violations being "a misdemeanor"
are deleted as unnecessary in light of §27—101
of this article to the same effect.
In subsection (a) of this section, the present
reference to an employee of a "registered
dealer" is deleted as misleading since only
dealers who also are inspection stations may
issue certificates in the first instance, and
those dealers are included in the reference to
an "inspection station"; see, §23—101(d) and
(f) of this title. The subsection also is
revised to prohibit wrongful issuances by an
"inspection station" itself; this is done to
cover the case of a sole proprietorship, for
example, where the individual issuing the
document might be the owner and, therefore,
not technically an "employee".
Subsection (b)(1) of this section is new
language added to conform the present
inconsistent references to "imitation,
counterfeit, or altered" certificates on the
one hand and "fictitious" certificates on the
other.
Subsection (d) of this section is revised to
conform to §23—103(c) of this title, which
requires surrender of the specified items only
if required by the Division.
The only other changes are in style.
