generally, to "comply with the order" within
the 30—day period. The only other changes are in style. In revising this section, the Commission notes
the absence of any requirement that a police
officer file a copy of a repair order with the
Division. Since such filing is critical to
proper enforcement, the General Assembly may
wish to amend this section accordingly. The Commission also notes the absence of any
guidelines for preventing the continued
operation of a vehicle found to be in
extremely hazardous condition. Although,
under its broad police powers (Art. 88B, §3 of
the Code), the State Police has adopted
guidelines for taking a vehicle "out of
service" if found to constitute a definite
risk of life or property, there would appear
to be a need for uniform Statewide standards
applicable to State and local police alike. 23-106. INSPECTION CERTIFICATE REQUIRED ON TRANSFER OF
USED VEHICLES. (A)   EXCLUSIONS. THIS SECTION DOES NOT APPLY TO: (1)   ANY TRANSFER OF A USED VEHICLE TO ANY
LICENSED DEALER OR TO ANY FOREIGN DEALER; (2)    ANY TRANSFER ACCOMPANIED BY A SIGNED
STATEMENT BY THE TRANSFEREE THAT THE TRANSFER IS MADE
FOR THE PURPOSE OF DISMANTLING OR REBUILDING THE VEHICLE; (3) ANY TRANSFER BETWEEN SPOUSES OR BETWEEN A
PARENT AND CHILD; (4)         ANY TRANSFER OF A USED VEHICLE THAT IS NOT TO BE BOTH TITLED AND REGISTERED IN THIS STATE; OR (5) ANY TRANSFER OF A USED VEHICLE BY THIS
STATE, A POLITICAL SUBDIVISION OF THIS STATE, OR ANY OF
THEIR AGENCIES. (B)       CERTIFICATE REQUIRED. (1)   IF ANY LICENSED DEALER THAT ALSO IS AN
INSPECTION STATION TRANSFERS ANY USED VEHICLE, IT SHALL
PREPARE AND ATTACH AN INSPECTION CERTIFICATE TO A WINDOW
OF THE VEHICLE. (2)   IF ANY OTHER PERSON TRANSFERS A USED
VEHICLE, THE PERSON SHALL OBTAIN AN INSPECTION
CERTIFICATE FROM AN INSPECTION STATION. THE INSPECTION
