REVISOR'S NOTE TO SECTION: Present Art. 66 1/2, §§
13-101(1) and 13-101(4), which define
"registered dealer" and "Administration",
respectively, are deleted as unnecessary in
light of the definitions in §§ 11—102 and
11-129 of this article.
Present Art. 66 1/2, §13-101(5), which
defines "State Police" to mean the "Department
of Maryland State Police", is deleted as
erroneous — since the State Police is no
longer a "Department" — and as unnecessary in
light of the consistent references in this
title to the Division.
23-102. AUTOMOTIVE SAFETY ENFORCEMENT DIVISION.
(A) ESTABLISHED.
THERE IS AN AUTOMOTIVE SAFETY ENFORCEMENT DIVISION
IN THE MARYLAND STATE POLICE.
(B) PERSONNEL.
THE DIVISION SHALL HAVE THOSE EMPLOYEES THAT THE
SUPERINTENDENT OF STATE POLICE ASSIGNS AND AS PROVIDED
IN THE STATE BUDGET.
(C) ENFORCEMENT OF TITLE.
THE DIVISION SHALL ENFORCE THIS TITLE IN EACH OF THE
COUNTIES OF THIS STATE.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §13-102 (a) and (c).
In subsection (c) of this section, the present
reference to Baltimore City is deleted as
unnecessary in light of the definition of
"county" in §1-101 of this article.
The only other changes are in style.
23-103. LICENSING OF INSPECTION STATIONS.
(A) INSPECTION AND APPROVAL OF FACILITIES.
ON RECEIPT OF AN APPLICATION FROM A FACILITY FOR AN
INSPECTION STATION LICENSE, THE DIVISION SHALL:
(1) INSPECT THE FACILITY AS TO ITS ABILITY
TO INSPECT AND CORRECT EQUIPMENT; AND
(2) IF THE FACILITY IS QUALIFIED, ISSUE TO IT
A LICENSE AS AN INSPECTION STATION.
