SUBTITLE 9. RECKLESS, NEGLIGENT, OR IMPAIRED DRIVING;
FLEEING OR ELUDING POLICE.
21-901. SCOPE OF SUBTITLE.
THE PROVISIONS OF THIS SUBTITLE APPLY THROUGHOUT
THIS STATE, WHETHER ON OR OFF A HIGHWAY.
REVISOR'S NOTE: This section, which is an exception
to the general rule established in §21—101.1
of this title, is new language derived without
substantive change from Art. 66 1/2,
§11-101(2).
21-901.1. RECKLESS AND NEGLIGENT DRIVING.
(A) RECKLESS DRIVING.
A PERSON IS GUILTY OF RECKLESS DRIVING IF HE DRIVES
A MOTOR VEHICLE:
(1) IN WANTON OR WILLFUL DISREGARD FOR THE
SAFETY OF PERSONS OR PROPERTY; OR
(2) IN A MANNER THAT INDICATES A WANTON OR
WILLFUL DISREGARD FOR THE SAFETY OF PERSONS OR PROPERTY.
(B) NEGLIGENT DRIVING.
A PERSON IS GUILTY OF NEGLIGENT DRIVING IF HE
DRIVES A MOTOR VEHICLE IN A CARELESS OR IMPRUDENT MANNER
THAT ENDANGERS ANY PROPERTY OR THE LIFE OR PERSON OF ANY
INDIVIDUAL.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-901.
Present references to reckless and negligent
driving as constituting a "misdemeanor" are
deleted as unnecessary in light of §27-101 of
this article.
