(5) MAY NOT SHIFT GEARS MANUALLY WHILE
PASSING OVER ANY TRACK OF THE RAILROAD.
(C) EXCEPTIONS.
THIS SECTION DOES NOT APPLY AT ANY RAILROAD GRADE
CROSSING IN A BUSINESS DISTRICT OR RESIDENTIAL DISTRICT.
REVISOR'S NOTE: This section presently appears as
Art. 66 1/2, §11-703.
In subsection (a)(2) of this section, the
broader term "school vehicle", which is
defined in §11-154 of this article, is
substituted for "school bus". This corrects
an apparent oversight in the recent
legislation that created a new distinction
between a "Type II" school vehicle and a "Type
I" school vehicle or "school bus".
In subsection (b) (2) of this section,
references to the "passage" of a railroad
train are added; see revisor's note to §21—701
of this subtitle.
In subsection (b) (4) and (5), the word
"manually" is added to modify "shift" to
reflect the advent of "automatic" shifts.
This conforms to one of the more recent
changes made to the UVC section after which
this section was originally patterned.
In subsection (c) of this section, the present
reference to a "street railway" is deleted as
obsolete.
The only other changes are in style.
21-704. MOVING HEAVY EQUIPMENT AT RAILROAD CROSSINGS.
(A) APPLICATION OF SECTION.
UNLESS A PERSON HAS COMPLIED WITH THIS SECTION, HE
MAY NOT DRIVE OR MOVE ON OR ACROSS ANY RAILROAD GRADE
CROSSING ANY POWER SHOVEL, DERRICK, ROLLER, CRAWLER-TYPE
TRACTOR, OR OTHER EQUIPMENT OR STRUCTURE THAT HAS:
(1) A NORMAL OPERATING SPEED OF 10 MILES AN
HOUR OR LESS; OR
(2) A VERTICAL BODY OR LOAD CLEARANCE,
MEASURED ABOVE THE LEVEL SURFACE OF A ROADWAY, OF LESS
THAN:
(I) ONE-HALF INCH FOR EACH FOOT OF THE
DISTANCE BETWEEN ANY TWO ADJACENT AXLES; OR
|
|
|
|
|
|
|
|
|
|
(II) 9 INCHES.
