Section 386A through [[386J]] 386K to be under the
new subtitle "Regulation of Public Water
Systems"
Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 386A through [[386J]] 386K to
be under the new subtitle "Regulation of Public Water
Systems" be and they are hereby added to Article 43 —
Health, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) to read as
follows:

Article 43 - Health

REGULATION OF PUBLIC WATER SYSTEMS

386A.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED:

(A)          "ADMINISTRATOR" MEANS THE ADMINISTRATOR OF THE
UNITED STATES ENVIRONMENTAL PROTECTION AGENCY.

(B)         [["CONTAMINATED"]] "CONTAMINANT" MEANS        ANY
[[PHYSICAL,]] CHEMICAL, BIOLOGICAL OR RADIOLOGICAL [[9
SUBSTANCE]] SUBSTANCE IN THE WATER[[.]] THAT WOULD CAUSE
ADVERSE HEALTH PROBLEMS.

(C)          "DEPARTMENT" MEANS THE DEPARTMENT OF HEALTH
AND MENTAL HYGIENE.

(D)          "FEDERAL ACT" MEANS THE SAFE DRINKING WATER
ACT, 88 STAT. 1660.

(E)          "FEDERAL AGENCY" MEANS ANY DEPARTMENT, AGENCY
OR INSTRUMENTALITY OF THE UNITED STATES.

(F)          "NATIONAL PRIMARY DRINKING WATER REGULATIONS"
MEANS PRIMARY DRINKING WATER REGULATIONS PROMULGATED BY
THE ADMINISTRATOR PURSUANT TO THE FEDERAL ACT.

(G)          "PERSON" MEANS AN INDIVIDUAL, CORPORATION,
COMPANY,        ASSOCIATION, PARTNERSHIP, COUNTY, MUNICIPAL
CORPORATION, THE WASHINGTON SUBURBAN SANITARY COMMISSION,
OR ANY SPECIAL TAXING AREA THAT OPERATES A PUBLIC WATER
SYSTEM.

(H)           "PRIMARY DRINKING WATER REGULATION" MEANS A

REGULATION WHICH:

(1)          APPLIES TO PUBLIC WATER SYSTEMS.

(2)          SPECIFIES CONTAMINANTS WHICH, IN THE
JUDGMENT OF THE [[DIRECTOR]] SECRETARY, [[MAY]] WOULD
