(h) "Person" includes THE FEDERAL GOVERNMENT, the
state, any county, municipal corporation, or other
political subdivision of the state, or any of their
units, or an individual, receiver, trustee, guardian,
executor, administrator, fiduciary, or representative of
any kind, or any partnership, firm, association, public
or private corporation, or any other entity.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning

Optional Retirement Programs — Morgan State University

FOR the purpose of authorizing the board of Morgan State
University to adopt the optional retirement program
in lieu of the Teachers' Retirement System for
qualified employees who elect such programs.

BY repealing and reenacting, with amendments,

Section 211(d) and 217(a)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 211(d) and 217(a) of Article 77 -
Public Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1975 Supplement) be and they are
hereby repealed and reenacted, with amendments, to read
as follows:

Article 77 — Public Education

211.

(d) In the event the board of [trustees of the State
colleges] MORGAN STATE UNIVERSITY adopts an optional
retirement program as provided in § 217 of this article,
those eligible employees of Morgan State [College]
UNIVERSITY who elected to participate in the optional
retirement program shall not participate in the Teachers'
Retirement System for any period in which they
participate in the optional retirement program. They
