FOR the purpose of clarifying that a minimum pension is
available to a judge who retires or submits an
application for retirement due to disability during
a certain period; and providing for the retroactive
effect of this Act.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 56(i) of Article 73B - Pensions,
of the Annotated Code of Maryland (1970 Replacement
Volume and 1975 Supplement) be and it is hereby repealed
[[and reenacted, with amendments, to read as follows:

Article 73B - Pensions

56.

(i) A judge who SUBMITS AN APPLICATION FOR
RETIREMENT OR retires due to disability during THE period
July 1, 1975, through July 1, 1977, shall be entitled to
a pension equivalent to NOT LESS THAN one third of the
annual salary for judges of that court in affect as of
the date of SUBMISSION OF THE APPLICATION FOR retirement.

SECTION 2. AND BE IT FURTHER ENACTED, That the
effect of this Act is retroactive to apply to and for any
judge who applied for retirement or retired at any time

from and after July 1, 1975. IN THE EVENT A JUDGE DIES

AFTER FILING FOR DISABILITY RETIREMENT WITHOUT HAVING HIS
APPLICATION REVIEWED AND APPROVED BY THE BOARD WITHIN THE

PERIOD SPECIFIED IN THIS SUBSECTION, THE JUDGE SHALL BE

CONSIDERED TO BE IN FACT RETIRED ON__DISABILITY AND HIS

SURVIVING SPOUSE SHALL BE PAID A PENSION EQUIVALENT TO

NOT LESS THAN ONE-HALF THE PENSION__HE WOULD__ HAVE BEEN

ENTITLED TO FOR DISABILITY RETIREMENT.]]

SECTION 2. AND BE IT FURTHER ENACTED, That Section

57(h) of Article 73B — Pensions, of the Annotated Code of
Maryland (1970 Replacement Volume and 1975 Supplement) be
and it is hereby repealed and reenacted, with amendments,
to read as follows:
