Ch. 283

Assembly has not prior to the end of its next regular
session after approval thereof of any rule, regulation or
code, disapproved such rule, regulation or code.]

SECTION 3.        AND BE IT FURTHER ENACTED, That new

Section [[12-603]] 12-602 be and it is hereby added to
Article 66 1/2 — Vehicle Laws, of the Annotated Code of
Maryland (1970 Replacement Volume and 1975 Supplement) to
read as follows:

Article 66 1/2 — Vehicle Laws

[[12-603]] 12-602. ADOPTION OF RECOMMENDATIONS.

[[(A) IN GENERAL.]]

BY RULE   OR REGULATION ADOPTED UNDER §2-307 OF

THIS ARTICLE, THE   ADMINISTRATOR MAY, IF NOT INCONSISTENT

WITH THIS ARTICLE,    ADOPT A RULE, REGULATION, OR CODE

RECOMMENDED BY THE   VEHICLE EQUIPMENT SAFETY COMMISSION.

[[(B) WHEN GENERAL ASSEMBLY APPROVAL REQUIRED.

(1)    IF A RECOMMENDED RULE, REGULATION, OR
CODE ADOPTED BY THE ADMINISTRATOR IS INCONSISTENT WITH
AND INTENDED TO SUPERSEDE AN EXISTING PROVISION OF THIS
ARTICLE PRESCRIBING MOTOR VEHICLE REQUIREMENTS, IT IS
EFFECTIVE ONLY AFTER APPROVAL HAS BEEN OBTAINED FROM THE
GENERAL ASSEMBLY AS SPECIFIED IN THIS SUBSECTION.

(2)    A RULE, REGULATION, OR CODE REQUIRING
APPROVAL OF THE GENERAL ASSEMBLY SHALL BE SUBMITTED IN AN
ADMINISTRATIVE REQUEST TO THE GENERAL ASSEMBLY WITHIN THE
FIRST TEN DAYS OF A REGULAR SESSION. THE REQUEST SHALL
SPECIFY THE PROVISIONS OF EXISTING STATUTE THAT WOULD BE
SUPERSEDED BY THE RECOMMENDED RULE, REGULATION, OR CODE.

(3)    A REQUEST SUBMITTED UNDER THIS
SUBSECTION IS CONSIDERED APPROVED UNLESS, WITHIN 50 DAYS
AFTER ITS SUBMISSION, IT IS SPECIFICALLY DISAPPROVED BY A
RESOLUTION OF DISAPPROVAL CONCURRED IN BY A MAJORITY VOTE
OF ALL MEMBERS OF EITHER HOUSE OF THE GENERAL ASSEMBLY.

(4) IF APPROVED AS PROVIDED IN THIS

SUBSECTION, THE RECOMMENDED RULE, REGULATION, OR CODE IS

EFFECTIVE ON THE    LATER OF THE DATE SPECIFIED IN THE

REQUEST OR THE DATE OF ITS APPROVAL BY THE GENERAL
ASSEMBLY.]]

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
