Except to the extent authorized by a contract
entered into under this subtitle, it is a violation of a
resale price restriction imposed on a commodity by the
contract to:

(1)    Offer or give any article of value in
connection with the sale of the commodity;

(2)   Offer or make any concession of any kind,
whether by the giving of coupons or otherwise, in
connection with the sale; or

(3)    Sell the commodity or offer it for sale
in combination with any other commodity.

(c) Available remedies.

The remedies prescribed by §11-107 are available for
each of the violations described in subsection (b) of
this section.

11—107. Unfair competition.

(a)   What constitutes unfair competition.

It is unfair competition willfully and knowingly to
advertise, offer for sale, or sell a commodity at less
than the price stipulated in a contract entered into
under this subtitle.

(b)   Remedy.

Any person damaged by a violation of this section
may bring an action against the violator, whether or not
the violator is a party to the contract.

11-108. Short title.

This subtitle may be cited as the Maryland Fair
Trade Act.]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
