LAWS OF MARYLAND

Ch. 234

INCLUDING ARCHITECTURAL SERVICES AND CAPITAL__EQUIPMENT

IN EXCESS OF ANY AVAILABLE FEDERAL FUNDS, FOR CENTERS
ACQUIRED, CONSTRUCTED, OR RENOVATED PURSUANT TO §710(B),
(D), (E), OR (F) AND IN ACCORDANCE WITH THIS SECTION.
THE BOARD OF PUBLIC WORKS SHALL, BY REGULATIONS,
DETERMINE WHAT ARE 'APPROVED COSTS. ALL REMAINING COSTS
FOR ACQUISITION, CONSTRUCTION, AND RENOVATION SHALL BE
PAID BY THE COUNTY.

(B) THE STATE SHALL, IN ADDITION, ENTER INTO AN
AGREEMENT WITH THE COUNTY OR COUNTIES TO PROVIDE A STATE
SUBSIDY TOWARD THE APPROVED OPERATING COSTS FOR CENTERS
ACQUIRED AND OPERATED BY THE COUNTY OR COUNTIES IN EXCESS
OF ANY AVAILABLE FEDERAL FUNDS AND INMATE CONTRIBUTIONS.
THE BOARD OF PUBLIC WORKS SHALL, BY REGULATIONS,
DETERMINE WHAT ARE APPROVED OPERATING COSTS. THE
REGULATIONS SHALL INCLUDE AS APPROVED OPERATING COSTS ALL
REASONABLE OPERATING EXPENSES NECESSARY TO INSURE THAT
THE CENTERS MEET THE MINIMUM STANDARDS ADOPTED BY THE
SECRETARY. THE STATE SUBSIDY SHALL BE DETERMINED AS
FOLLOWS:

(1)    FIRST, THE APPROVED OPERATING     COSTS OF
THE CENTER IN EXCESS OF AVAILABLE FEDERAL   FUNDS AND
CONTRIBUTIONS FOR ROOM AND BOARD BY THE INMATES   SHALL BE
DETERMINED ON A PER DIEM BASIS.

(2)    THIS PER DIEM APPROVED COST SHALL THEN,
ON A DAILY BASIS, BE DIVIDED BY THE NUMBER OF INMATES
THEN RESIDING IN THE CENTER.

(3)    THE AMOUNT OF THE STATE SUBSIDY SHALL BE
THE PER DIEM PER PERSON APPROVED COST IN EXCESS OF
AVAILABLE FEDERAL FUNDS AND INMATE CONTRIBUTIONS TIMES
THE NUMBER OF PERSONS RESIDING IN THE CENTER EACH DAY WHO

(I) HAVE BEEN PLACED IN THE CENTER UNDER A SENTENCE OF
MORE THAN 90 DAYS PURSUANT TO §710C(A) OR (II) HAVE BEEN
TRANSFERRED TO THE CENTER PURSUANT TO §710C(B).

(4)    THE STATE SUBSIDY SHALL BE PAID AT LEAST
ANNUALLY, AND MORE OFTEN AS DETERMINED BY THE BOARD OF
PUBLIC WORKS.

[[(C) THE COMMISSIONER, WITH RESPECT TO PERSONS
PLACED OR TRANSFERRED BY HIM, SHALL PROVIDE FOR
REASONABLE CONTRIBUTIONS TO BE MADE FOR THE COST OF ROOM
AND BOARD BY INMATES FROM THEIR EARNINGS AS A RESULT OF
WORK RELEASE PROGRAMS.]]

(C) THE AGREEMENT FOR A STATE SUBSIDY SHALL BE
NEGOTIATED AND ENTERED INTO PRIOR TO THE COMMENCEMENT OF
CONSTRUCTION OR RENOVATION OF A CENTER.

(D) IF A COUNTY OBTAINS FEDERAL FUNDS SPECIFICALLY
DESIGNATED TO FINANCE PROGRAMS OR STAFF IN EXCESS OF THE

MINIMUM STATE STANDARDS ADOPTED BY THE SECRETARY, IT MAY

ACCEPT AND USE SUCH FUNDS FOR THAT PURPOSE. THE STATE
SUBSIDY UNDER SUBSECTION (B) SHALL NOT BE REDUCED BY
