(G) THE WARDEN AND DEPUTY WARDEN OF THE BALTIMORE
CITY JAIL HAVE THE SAME LEAVE AUTHORITY WITH RESPECT TO
INMATES OF THE BALTIMORE CITY JAIL THAT THE COMMISSIONER
OF CORRECTION HAS UNDER THIS SECTION WITH RESPECT TO
INMATES UNDER THE JURISDICTION OF THE DEPARTMENT OF
CORRECTION, AND THE PROVISIONS OF THIS SECTION APPLY TO
COMPASSIONATE LEAVE FOR INMATES OF THE JAIL. REFERENCE
TO THE DEPARTMENT OF CORRECTION IN THIS SECTION MEANS THE
BALTIMORE CITY JAIL BOARD IN RELATION TO THE JAIL.

SPECIAL PRERELEASE PROGRAM LEAVE FOR INMATES OF THE JAIL.

(G) THE WARDEN OF THE BALTIMORE CITY JAIL HAS THE
SAME LEAVE AUTHORITY WITH RESPECT TO INMATES OF THE
BALTIMORE CITY JAIL THAT THE COMMISSIONER OF CORRECTION
HAS UNDER THIS SECTION WITH RESPECT TO INMATES UNDER THE
JURISDICTION OF THE DEPARTMENT OF CORRECTION, AND THE
PROVISIONS OF THIS SECTION APPLY TO FAMILY LEAVE FOR
INMATES OF THE JAIL, EXCEPT THAT "WARDEN" MEANS DEPUTY
WARDEN IN RELATION TO THE JAIL.
SECTION 2. AND BE IT FURTHER ENACTED, That Section
700D of Article 27 — Crimes and Punishments, of the
Annotated Code of Maryland (1971 Replacement Volume and
1975 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 27 - Crimes and Punishments
700D.
(A) Upon the recommendation of treatment staff,
with the approval of the warden or superintendent of any
State penal or reformatory institution under his
jurisdiction, the Commissioner of Correction may
authorize special leave to an inmate either within or
without this State to leave an institution for
participation in special community or other meritorious
programs or activities deemed beneficial to the inmate,
and not detrimental to the public, by both the warden or
superintendent and the Commissioner of Correction and
which in their judgment would contribute to the
rehabilitation process of the respective inmate. To be
considered for this special leave the inmate shall be
eligible solely upon the concurrence of the warden or
superintendent and the Commissioner of Correction that
positive attitudinal and growth patterns are being
established. All special leaves must be issued in
