3176                                   MUNICIPAL CHARTERS

Rising Sun, adopted pursuant to the authority of
Article XIE of the Constitution of Maryland, and
Section 19 of Article 23A of the Annotated Code of
Maryland (1957 Edition), 1966 Replacement Volume,
entitled "Corporations - Municipal", for the
enlargement of the corporate boundaries of said town
by the annexation of certain land contiguous to and
adjoining the existing corporate area by amending
the provisions of the Cecil County Code, Chapter 31,
which incorporates the Charter of the Town of Rising

Sun, Section 31-9, entitled Corporate boundaries,

and more particularly subsection (a) thereof, by
substituting a new subparagraph (5) for the present
subparagraph (5), and changing the present
subparagraph (5) to subparagraph (6).

WHEREAS, in accordance with Section 19(c) of Article
23A of the Annotated Code of Maryland (1957 Edition) at
least twenty—five per centum (25%) or more of the
registered voters in county elections who reside in the
hereinafter described area to be annexed, and the owners
of at least twenty—five per centum (25%) of the assessed
valuation in the said area having properly petitioned the
Board of Commissioners of the Town of Rising Sun to annex
said area into the corporate boundaries of the Town of
Rising Sun; and

WHEREAS, upon presentation of the petition to the
Board of Commissioners of the Town of Rising Sun, the
presiding officer thereof caused to be made a
verification of the signatures thereon and ascertained
that the persons signing the said petition were at least
twenty—five per centum (25%) of the registered voters for
county elections who reside in the hereinafter described
area to be annexed; and

WHEREAS, upon presentation of the petition to the
Board of Commissioners of the Town of Rising Sun, the
presiding officer thereof caused to be made a
verification of the signatures thereon and ascertained
that the persons signing the said petition owned at least
twenty-five per centum (25%) or more of the assessed
valuation of the real property located in the area to be
annexed; and

WHEREAS, the Board of Commissioners, upon proper
verification of the requirements of the law as
hereinabove set forth, have caused this resolution to be
introduced, proposing the change of boundaries as
requested in the said petition;

[Section 31-9 of the Code of Public Local Laws of
Cecil County, repealed and reenacted with amendments.
