SECTION 2. AND BE IT FURTHER ENACTED, That

authority to collect recordation taxes pursuant to a tax

rate fixed from time to time by resolution or ordinance

of a county or Baltimore City and applying on or after

July 1, 1963, is hereby ratified, confirmed, and

validated,

This Section 2 of the Act is not intended to apply

to relevant actions which are res judicata, nor whenever
constitutionally protected rights would be impaired.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure and
necessary for the immediate preservation of the public
health and safety and having been passed by a yea and nay
vote supported by three—fifths of all the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.
