Ch. 824

provisions of this Act shall not be construed to extend
or apply to the salary of the State's Attorney and Deputy
State's Attorneys in office on the effective date of this
Act, but the provisions of this Act concerning the salary
of the State's Attorney and Deputy State's Attorneys
shall take effect at the beginning of the next following
term of office.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

(House Bill 1813)

AN ACT concerning

Chartered Counties — Waiver of Immunity

FOR the purpose of permitting chartered counties to waive
the defense of sovereign immunity in certain cases;
and requiring any county waiving this defense to
establish an insurance program.

BY adding to

Article 25A — Chartered Counties of Maryland

Section 5 (CC)

Annotated Code of Maryland

(1973 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 5 (CC) be and it is hereby
added to Article 25A — Chartered Counties of Maryland, of
the Annotated Code of Maryland (1973 Replacement Volume
and 1975 Supplement) to read as follows:

Article 25A — Chartered Counties of Maryland

5.

(CC) TO PROVIDE BY ORDINANCE OR INCLUSION IN THE
COUNTY CHARTER FOR THE WAIVER OF SOVEREIGN IMMUNITY SO
THAT THE COUNTY MAY BE SUED IN TORT ACTIONS IN THE SAME
MANNER AND TO THE SAME EXTENT THAT ANY PRIVATE PERSON MAY
BE SUED. ANY CHARTERED COUNTY ENACTING LEGISLATION OR
OTHERWISE WAIVING SOVEREIGN IMMUNITY UNDER THIS
SUBSECTION SHALL CARRY COMPREHENSIVE LIABILITY INSURANCE
TO PROTECT ITSELF, ITS AGENTS AND ITS EMPLOYEES. THE
