SECTION 4. AND BE IT FURTHER ENACTED, That Sections
37(e) (10), (11), (12), and (13) respectively, of Article
77 - Public Education, of the Annotated Code of Maryland
(1975 Replacement Volume and 1975 Supplement) be and they
are hereby renumbered to be Sections 37(e) (9), (10),
(11), and (12), respectively.

SECTION 5. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure and
necessary for the immediate preservation of the public
health and safety and having been passed by a yea and nay
vote supported by three—fifths of all the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.

SECTION 6. AND BE IT FURTHER ENACTED, That before
this Act becomes effective it shall first be submitted to
a referendum of the legally qualified voters of Garrett
County at a special election to be held at the same time
as the primary election in May 1976. The Board of County
Commissioners and the Board of Supervisors of Election of
Garrett County shall do those things necessary and proper
to provide for and hold the referendum here required.
There shall be printed on the ballots or ballot labels to
be used at this election the title of this Act and
underneath the title, on separate lines, a square or box
to the right of and opposite the words: "For Elected
School Board" and a corresponding square or box to the
right of and opposite the words "Against Elected School
Board" so that each voter of the county may designate his
or her decision for or against the provisions of this
Act. If a majority of the votes cast in the election are
"For Elected School Board" the provisions of this Act
shall become effective on [[(]]the 30th day following the
official canvass of votes for the referendum[[) ]], but if
a majority of the votes cast in the election are "Against
Elected School Board" the provisions of this Act shall be
of no effect and null and void.
