IN RULES AND REGULATIONS THAT THE DEPARTMENT ADOPTS.

(B)    WHEN THE DEPARTMENT ENTERS INTO AN AGREEMENT
FOR CONSTRUCTION OF A PROJECT, THE DEPARTMENT SHALL
ASSIGN TO THE PROJECT A PRIORITY LIST NUMBER.

(C)    THE DEPARTMENT SHALL PROCEED WITH CONSTRUCTION
OF PROJECTS IN ACCORDANCE WITH THE PRIORITY SCHEDULE.
HOWEVER, IF AT ANY TIME THE COST OF A PROJECT AT THE TOP
OF THE PRIORITY LIST EXCEEDS THE UNOBLIGATED BALANCE OF
THE ACCOUNT, THE DEPARTMENT MAY PROCEED WITH CONSTRUCTION
OF A LOWER PRIORITY PROJECT.

(D)    ON SATISFACTORY COMPLETION OF CONSTRUCTION,
ANY PROPERTY OWNER'S CASH CONTRIBUTION SHALL BE ENDORSED
TO THE CREDIT OF THE CONTRACTOR. THE ACCOUNT SHALL PAY
THE BALANCE OF THE PAYMENT DUE THE CONTRACTOR. WITHIN 30
DAYS AFTER THE PAYMENT, THE DEPARTMENT SHALL CERTIFY TO
THE BOARD OF PUBLIC WORKS PAYMENT OF THE CONSTRUCTION
COSTS AND TRANSMIT A COPY OF THE AGREEMENT SPECIFYING HOW
THE STATE WILL BE REIMBURSED FOR THE NET PROJECT
CONSTRUCTION COST.

ENGINEERING, TECHNICAL, AND ADMINISTRATIVE SERVICES
REQUIRED TO IMPLEMENT THIS SUBTITLE, INCLUDING REVIEW AND
EVALUATION OF REQUESTS FOR ASSISTANCE, DESIGN OF ORPHANED
LAND RECLAMATION PROJECTS, SUPERVISION OVER CONSTRUCTION
OF APPROVED PROJECTS, AND INSPECTION OF COMPLETED
PROJECTS TO INSURE ADEQUATE MAINTENANCE, SHALL BE FUNDED
AS PROVIDED IN THE STATE BUDGET. COSTS OF SERVICES
ENUMERATED IN THIS SECTION ARE NOT PROJECT COSTS AND
SHALL BE BORNE SOLELY BY THE STATE.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
