AN ACT concerning
Small Business — State Purchases
FOR the purpose of insuring that small businesses receive
a fair proportion of the State's total purchases for
property and services by enabling [[the Secretary of
General Services]] certain Secretaries to designate
certain purchases of commodities, equipment, and
services as small business set—asides; specifying
certain procedures for the purchases; defining
certain terms; requiring certain [[records to be
kept]] reports to the Committee on Administrative,
Executive and Legislative Review; and generally
relating to small business set-asides.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 231GH be and it is hereby
added to Article 41 — Governor — Executive and
Administrative Departments, of the Annotated Code of
Maryland (1971 Replacement Volume and 1975 Supplement) to
read as follows:

231GH.
(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE
THE MEANINGS INDICATED.
(2) "SECRETARY" MEANS THE SECRETARY OF
GENERAL SERVICES , THE SECRETARY OF THE DEPARTMENT OF
TRANSPORTATION, OR THE SUPERINTENDENT OF THE STATE
DEPARTMENT OF EDUCATION.
(3) "SMALL BUSINESS" HAS THE MEANING
ESTABLISHED BY THE SECRETARY IN ROLES AND REGULATIONS,
SUBJECT TO THE CRITERIA SET FORTH IN SUBSECTION (B) OF
THIS SECTION.
(4) "SMALL BUSINESS SET-ASIDE" MEANS A
PURCHASE REQUEST FOR WHICH THE SECRETARY INVITES [[AND
ACCEPTS BIDS ONLY FROM SMALL BUSINESSES]] BIDS FROM A
LIST OF QUALIFIED BIDDERS INCLUDING SMALL BUSINESSES.
(B) (1) THE SECRETARY SHALL ADOPT RULES AND
REGULATIONS SPECIFYING THE CRITERIA FOR QUALIFICATION AS
A SMALL BUSINESS.
