certification of need, it is understood that the generic
form of the drug from the State [Health] Department OF
HEALTH AND MENTAL HYGIENE formulary or the list [prepared
according to federal regulation 45CFR Part 19 (Maximum
Allowable Cost) ] OF MULTIPLE-SOURCE DRUGS [[DESIGNATED]]
AS FINALLY DETERMINED AND PUBLISHED BY THE PHARMACEUTICAL
REIMBURSEMENT BOARD, UNITED STATES DEPARTMENT OF HEALTH,
EDUCATION, AND WELFARE, will be utilized in filling the
prescription.

(7) The Department of Health and Mental
Hygiene may establish the form and method of application
for reimbursement under this section.

(c) The provisions of this section shall only apply
to those drug products included in the Maryland Medical
Assistance Formulary determined by the Maryland
Department of Health and Mental Hygiene on the basis of
scientific evidence to be clinically equivalent and those
[drug products approved for listing according to
procedures in federal regulations 45CFR Part 19 entitled
Maximum Allowable Cost for Drugs] MULTIPLE-SOURCE DRUGS
[[DESIGNATED BY]] AS FINALLY DETERMINED AND PUBLISHED BY
THE PHARMACEUTICAL REIMBURSEMENT BOARD, UNITED STATES
DEPARTMENT OF HEALTH, EDUCATION, AND WELFARE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning

Health — Medical Review Committees

FOR the purpose of creating Medical Review Committees;
providing definitions; providing certain functions
of the Medical Review Committees; requiring certain
records and proceedings under certain conditions to
be confidential; and establishing immunity from
prosecution for certain persons and Medical Review
Committees if actions are taken in good faith and
are made within the scope of the functions of the
Committee.
