OPERATED BY AN AGENCY OF THIS STATE OR ANY POLITICAL
SUBDIVISION.

21.

(A)    EXCEPT AS PROVIDED IN SUBSECTION (B), A PERSON
MAY NOT OPERATE AN INSTITUTION FOR THE CARE, CUSTODY, OR
CONTROL OVER A CHILD ALLEGED OR ADJUDICATED AS DELINQUENT
OR IN NEED OF SUPERVISION WITHOUT HAVING FIRST OBTAINED A
LICENSE FROM THE STATE [[DEPARTMENT OF HEALTH AND MENTAL
HYGIENE, THE]] JUVENILE SERVICES ADMINISTRATION[[, OR THE
STATE DEPARTMENT OF HUMAN RESOURCES]].

(B)   THE REQUIREMENTS OF SUBSECTION (A) DO NOT APPLY

(1)    TO AN INSTITUTION OR FACILITY OPERATED
BY AN AGENCY OF THIS STATE OR ANY POLITICAL SUBDIVISION;
OR

(2)    TO A CHILD CARE HOME POSSESSING A
LICENSE PURSUANT TO ARTICLE 88A, SECTION 20A OR SECTION
20 OF THIS ARTICLE.

22.

(A)    THE JUVENILE SERVICES ADMINISTRATION SHALL
ADOPT RULES AND REGULATIONS FOR THE ADMINISTRATION OF
SECTIONS 20 AND 21 OF THIS ARTICLE NO LATER THAN JANUARY
1, 1977. THE RULES MAY PROVIDE FOR PROVISIONAL LICENSING
OF EXISTING FACILITIES UNTIL JULY, 1978.

(B)    A CHILD CARE HOME OR INSTITUTION MAY NOT BE

REQUIRED TO OBTAIN A LICENSE FROM MORE THAN ONE STATE
AGENCY. ANY STATE AGENCY AUTHORIZED TO LICENSE CHILD CARE
HOMES MAY ENTER INTO COOPERATIVE ARRANGEMENTS WITH ANY
OTHER STATE AGENCY OR AGENCIES TO [[THE]] THIS END [[THAT
ONLY ONE LICENSE MAY BE REQUIRED]].

(C)    IT IS THE INTENTION OF THE GENERAL ASSEMBLY
THAT ALL CHILDREN WHOSE CARE IS THE RESPONSIBILITY OF THE
STATE SHALL HAVE SIMILAR PROTECTION IN TERMS OF HEALTH,
SAFETY AND QUALITY OF CARE; AND THAT RULES AND
REGULATIONS OF AGENCIES CHARGED WITH CHILD CARE SHALL BE
COMPARABLE.

SECTION 2. AND BE IT FURTHER ENACTED, That Sections
20A(a), [[20A(b)(4)]] 20A(b) and [[20B(a)]] 20B of
Article 88A - Social Services Administration, of the
Annotated Code of Maryland (1969 Replacement Volume and
1975 Supplement) be and they are hereby repealed and
reenacted, with amendments, to read as follows:

Article 88A — Social Services Administration

20A.

(a) Except as provided in subsection (b) hereof,
no person may exercise care, custody, or control over a
