QUALIFIES. AN APPOINTMENT TO A VACANCY IN AN UNEXPIRED
TERM IS LIMITED TO THE REMAINDER OF THAT TERM. THE
MEMBERS SHALL SERVE WITHOUT COMPENSATION, EXCEPT THAT
MEMBERS WHO ARE NOT STATE EMPLOYEES SHALL BE COMPENSATED
FOR EXPENSES AS PROVIDED IN THE BUDGET OF THE DEPARTMENT.
THE COUNCIL SHALL ELECT ANNUALLY A CHAIRPERSON FROM AMONG
ITS MEMBERS APPOINTED FROM THE PUBLIC AT LARGE.
(F) THERE IS A MARYLAND HAZARDOUS SUBSTANCE
CONTROL FUND. THE DEPARTMENT SHALL USE THE FUND FOR:
[[(1) EMERGENCY REMOVAL OF ALL HAZARDOUS
SUBSTANCES FROM THE WATERS OF THE STATE;]]
(1) EMERGENCY REMOVAL OR MITIGATION OF THE
EFFECT OF DESIGNATED HAZARDOUS SUBSTANCES CONTAINED IN
THE WATERS OF THE STATE;
(2) IDENTIFYING AND, WHERE FEASIBLE,
RESTORING NATURAL RESOURCES THAT HAVE BEEN DAMAGED BY
[[THE DISCHARGE OF]] DESIGNATED HAZARDOUS SUBSTANCES; AND
(3) PROGRAM DEVELOPMENT ACTIVITIES DESIGNED
TO IDENTIFY, MONITOR, AND CONTROL THE PROPER
[[DISPOSITIONS]] DISPOSAL OF DESIGNATED HAZARDOUS
SUBSTANCES.
EXCEPT FOR APPLICATION FEES, ALL PERMIT FEES,
RENEWAL FEES, AND ANY OTHER CHARGES, MADE BY THE
DEPARTMENT UNDER THIS [[SUBTITLE]] SECTION, SHALL BE
CREDITED TO THE FUND.
(G) EXCEPT AS PROVIDED IN [[THIS SECTION]] SECTION
3-1413 AND REGULATIONS ADOPTED PURSUANT TO THIS SUBTITLE,
A PERSON ONLY MAY DISPOSE OF DESIGNATED HAZARDOUS
SUBSTANCES IN A FACILITY.
(H) AFTER SIX MONTHS FROM THE DATE THE DEPARTMENT
ADOPTS A REGULATION [[IDENTIFYING]] DESIGNATING HAZARDOUS
SUBSTANCES, [[EVERY PERSON WHO GENERATES OR UTILIZES
HAZARDOUS SUBSTANCES]] ANY PERSON WHO UTILIZES OR
DISPOSES OF DESIGNATED HAZARDOUS SUBSTANCES, EXCEPT THOSE
UTILIZED FOR RESIDENTIAL PURPOSES OR THOSE REGULATED BY
THE DEPARTMENT OF AGRICULTURE, SHALL NOTIFY THE
DEPARTMENT IN WRITING, ON THE FORM PROVIDED BY THE
DEPARTMENT, OF THE FOLLOWING:
(1) THE NAMES AND VOLUMES OF THE DESIGNATED
HAZARDOUS SUBSTANCES [[HANDLED, UTILIZED, OR GENERATED]];
AND
[[ (2) THE MANNER OF THEIR CONTROL, DISPOSAL,
OR STORAGE.]] (2) THE MANNER OF THEIR MANAGEMENT OR
DISPOSAL.
(I) AFTER JULY 1, 1977, A PERSON MAY NOT OPERATE
OR MAINTAIN A FACILITY WITHOUT A PERMIT ISSUED BY THE
DEPARTMENT. THE DEPARTMENT MAY NOT ISSUE A PERMIT UNTIL
