AN ACT concerning

Pensions - Average Final Compensation

FOR the purpose of excluding certain extraordinary salary
increases in the determination of "average final
compensation"; generally relating to definition of
"average final compensation"; and clarifying
language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 1 (15) of Article 73B - Pensions,
of the Annotated Code of Maryland (1970 Replacement
Volume and 1975 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:

Article 73B — Pensions

1.

The following words and phrases as used in this
article, unless a different meaning is plainly required
by the context, shall have the following meanings:

(15) "Average final compensation" [shall mean]
MEANS the average annual earnable compensation of an
employee for the three years of service as an employee
during which [his] THE EMPLOYEES earnable compensation
was highest, or if [he] THE EMPLOYEE had less than three
years of service, then [his] THE EMPLOYEE'S average
