THE THIRD DEGREE PURSUANT TO (A) (2) AND (3) IF THE
SEXUAL CONTACT IS FOR ACCEPTED MEDICAL PURPOSES.]]

(3) WITH ANOTHER PERSON WHO IS MENTALLY

DEFECTIVE. MENTALLY INCAPACITATED, OR PHYSICALLY

HELPLESS. AND THE PERSON KNOWS OR SHOULD KNOW THE OTHER
PERSON IS MENTALLY DEFECTIVE. MENTALLY INCAPACITATED, OR
PHYSICALLY HELPLESS.

[[(C)]] (B) THE COMMISSION OF A SEXUAL OFFENSE IN
THE THIRD DEGREE IS A FELONY PUNISHABLE BY IMPRISONMENT
UP TO TEN YEARS.

464A.

(A) A PERSON IS GUILTY OF A SEXUAL OFFENSE IN THE
FOURTH DEGREE IF THE PERSON ENGAGES:

(1) IN SEXUAL CONTACT WITH ANOTHER PERSON
AGAINST THE WILL AND WITHOUT THE CONSENT OF THE OTHER
PERSON: OR

(2) IN A SEXUAL ACT WITH ANOTHER PERSON WHO
IS 14 OR 15 YEARS OF AGE WHICH AGE THE PERSON PERFORMING
THE SEXUAL ACT KNOWS OR SHOULD KNOW AND THE PERSON
PERFORMING THE SEXUAL ACT IS 4 OR MORE YEARS OLDER THAN
THE OTHER PERSON.

(B) THE COMMISSION OF A SEXUAL OFFENSE IN THE
FOURTH DEGREE IS A MISDEMEANOR PUNISHABLE BY IMPRISONMENT
UP TO ONE YEAR.

A PERSON MAY NOT BE PROSECUTED UNDER THIS SUBTITLE
IF THE COMPLAINANT IS THE PERSON'S LEGAL SPOUSE UNLESS
THE PARTIES AND LIVING SEPARATE AND APART, PURSUANT TO
COURT ORDER.]]

464B.

A PERSON MAY NOT BE PROSECUTED UNDER THIS SUBTITLE
IF THE VICTIM IS THE PERSON'S LEGAL SPOUSE AT THE TIME OF
THE COMMISSION OF THE ALLEGED SEXUAL OFFENSE UNLESS THE
PARTIES ARE LIVING SEPARATE AND APART PURSUANT TO A
DECREE OF DIVORCE A MENSA ET THORO.

(A) A PERSON MAY NOT:

(1)          PUT INTO THAT PERSON'S MOUTH THE SEXUAL
ORGAN OF AN ANIMAL; OR

(2)          PUT THAT PERSON'S SEXUAL ORGAN IN THE
MOUTH OF AN ANIMAL; OR

(3)          COMMIT ANY OTHER UNNATURAL OR PERVERTED
